Terms and Conditions

1. General Use of Products

By purchasing, using, or accessing any products or content supplied by AB: Handmade with Love™ and AB Lumière™ (collectively, “the Business”), the customer or user acknowledges and agrees that all products are used at their own risk.

 

2. No Liability for Misuse or Improper Use

The Business is not responsible or liable for any injury, damage, loss, or adverse reaction arising from:

  • Improper, unsafe, or negligent use of candles, chocolate candles, skincare, or other products;

  • Failure to follow product instructions, warnings, or safety guidelines;

  • Misuse, alteration, or modification of any product;

  • Unattended burning of candles, improper placement, or unsafe handling;

  • Ingestion, incorrect handling, or unsafe use of edible chocolate candles.

3. Edible Chocolate Candle Disclaimer
Customers acknowledge that edible chocolate candles are intended for limited consumption and decorative use only. The Business is not liable for any illness, allergic reaction, or harm resulting from ingestion, misuse, or improper handling.

 

4. Candle Safety Disclaimer
Customers understand that candles are a fire hazard. The Business is not liable for fire, burns, smoke damage, or property damage arising from improper use.

 

5. Limitation of Liability
To the maximum extent permitted by law, the Business’s total liability, whether in contract, tort, or otherwise, is limited to the purchase price of the product. The Business is not liable for indirect, consequential, or special damages.

 

6. Intellectual Property Protection

All content, products, designs, logos, images, recipes, fragrances, formulas, product instructions, and website materials of AB: Handmade with Love™ and AB Lumière™ are the exclusive property of the Business.

 

Customers and visitors acknowledge that:

  • They may not copy, reproduce, distribute, sell, or use any content, product design, or ideas without written permission;

  • They may not reverse-engineer, replicate, or create derivative products based on the Business’s products or intellectual property;

  • Any unauthorized use of the Business’s intellectual property will be treated as theft, infringement, and may result in legal action;

  • All brand names, logos, and designs are protected by common law and trademark rights, including AB: Handmade with Love™ and AB Lumière™.

7. Indemnity & Limitation of Liability

By purchasing or using any products from AB: Handmade with Love™ and AB Lumière™ (“the Business”), you agree to the following terms:

  1. Instructions and Warnings
    All products include clear instructions and safety warnings on the packaging. You must read, understand, and follow these instructions carefully before use.

  2. Assumption of Risk
    You acknowledge that all products are used at your own risk. The Business is not responsible for any injury, damage, or loss arising from the use of its products.

  3. Misuse or Abuse
    The Business cannot be held liable for any misuse, abuse, or improper handling of products, including any resulting injury, property damage, or financial loss.

  4. Indemnity
    You agree to indemnify, defend, and hold harmless the Business, its owners, employees, and agents from any claim, demand, liability, or loss arising from your failure to follow product instructions or warnings, or from any misuse or abuse of the products.

  5. Legal Effect
    This clause is intended to be legally enforceable under New Zealand law. Where any part of this clause is found unenforceable, the remainder will continue in full effect.

8. Acceptance of Terms

By purchasing, using, or accessing any products or content from AB: Handmade with Love™ or AB Lumière™, the customer agrees to these Terms in full and acknowledges that:

  • They are responsible for safe use of products;

  • They respect the Business’s intellectual property and will not attempt to copy or steal products, designs, or ideas;

  • Violation of these Terms may result in civil and criminal legal action.
